Real estate Q&A: How can I help my children avoid probate after I'm gone?

Q: I live in a condo in a 55+ community and want to help my children avoid probate when I eventually pass away. What should I do? -- Sheryle

A: This is a question asked of me many years ago by my most loyal reader, my mother. I answered her question in person at the time and will now share that answer with you because my mother passed away this week, and her foresight with this question, and the action we took, will spare us the expense and hassle of having to probate her home.

Kindly remember that everyone's situation is unique, and a newspaper column is not a substitute for the advice of an estate planning attorney.

There are three good choices depending on your situation. The first choice is a Life Estate Deed, where property owners retain ownership of the home for their lifetimes, and when they die, the home passes to their initial choice of recipients without any further action being required. Simply, once the "life-tenant" passes away, the chosen person (or people), known as the "remainderman," automatically becomes the owner. The downside to this choice is that the chosen remaindermen are "vested," meaning their interest in the property is locked in. The property owner cannot later change his or her mind, sell or even mortgage the property without the remainderman's consent.

To fix this problem, an Enhanced Life Estate Deed was developed. This type of deed became known as a "Lady Bird Deed" following an article years ago illustrating its uses by a prominent Florida attorney. The name stuck, as did the document because of its usefulness. This type of ownership is very similar to a standard life estate, but the remainderman's interest in the property is not vested, meaning the homeowner can freely change his or her mind about who takes the property afterward, and can sell or mortgage the property without anyone's consent. This flexibility can also be a downside, since some seniors are susceptible to influence and may be coerced into making changes that are not in their best interest.

The final choice is to set up a living trust. This choice provides the most flexibility and is best for people with more assets to plan for. While trusts are almost all upside, the negative is they are significantly more expensive and complicated to set up than either type of life estate deed.

This is the season when hearts gather in gratefulness.

On Thanksgiving, one little child will sit with hands folded, his head bowed in prayer, not yet realizing the magnitude of thankfulness to surround him. But those who love him know this little boy's gentle moment was unimaginable just 3 1/2 years ago.

"He was a meth baby," Brittney Tejeda said, remembering history she learned while he was in their foster care.

"His bio mom abused meth daily - among other things - and she had him almost 2 months early."

From the moment this infant's life began in 2015, there was distress.

His mother's drug addiction while he was in the womb, and life-threatening complications just before Ethan's delivery, presented forbidding challenges. An emergency Cesarean, early loss of amniotic fluid, a brain bleed and collapsed lung left doctors with little hope for Ethan -- a name meaning "strong and long-lived."

But could he breathe life into that name?

One night in the Neonatal Intensive Care Unit. One week in NICU. Hope glimmered for this premature baby.

As days passed, Ethan fought to survive under the watchful eye of Kadlec Medical Center's team in Richland, Washington. What likely should have been a mother's moment-by-moment anticipation for the hour he could go home, instead became an exit door. She abandoned her newborn son.

Foster care was Ethan's foreseeable future. Yet, on the horizon, a blessing couldn't be seen - a "forever home," one held in another's heart long before this precious baby was even born.

"I first became interested in foster care as a small child. I remember it being around kindergarten age," Brittney said thoughtfully, as she described the at-risk home where she grew up. "So, we constantly were divided up as siblings between different family members."

During one stay at her grandmother's an impressionable moment created a permanent heart's desire.

"There was another little girl about my age, and Grandma favored me over this foster girl," Brittney said. She recalls emotions she felt. "And it really bothered me to see how Grandma would buy me the extra candy, ice cream, or the pretty dress, and this other child wouldn't get anything as much."

"About that age I decided I would be a foster parent."

Too young to know her life's purpose? Not for this little girl. Later, as a young woman, I was determined to not let even romance stand in my way.

"When I met my husband, it was, at most, a week and a half getting to know each other and we weren't official yet. And I asked, 'How many children do you want?'"

"We weren't on that subject yet!" Brittney said, smiling at how the unexpected conversation led to discuss foster care.

"He had a confused look like, 'What's that?' And I explained it and he said, 'Yes, I would do that. It sounds great.'

"Had he said 'No,' or 'I'm not sure' and wasn't confident, it wouldn't become a relationship later."

Their love blossomed. Marriage, home, and education for both in the health field followed. Brittney and husband Nic were now ready to find a foster child to join his 11-year old daughter.

"God made me for this. This is why I'm here," 31-year-old Brittney said about signing up to be a foster parent, and then added lightly, "I trained for years by being the oldest of seven. He made sure I was ready."

Equipped for respite foster care (stepping in when foster parents need relief), Brittney received a typical call on a wintry February morning in 2016 to care for another child, something she and Nic had done frequently. This was atypical. This busy mom had some free time when the plea came for immediate extended help.

Looking back, it was a godsend.

"Usually if the placement coordinator called on a Monday, I'd normally be unavailable," Brittney said. She worked on-call weekdays as a surgical technician and kept weekends free for her family.

"But this particular Monday, I didn't have a single shift assigned to me for that entire week."

Within the hour, an overwhelmed foster mom briefly dropped by with the 7-month-old baby, car seat and bag of clothing. What's missing for the weeklong stay? Any instructions for the infant's care.

"Ethan was so fragile. He was very ill and he didn't sleep -- and he cried constantly," Brittney said, remembering the difficult situation. But the instant bond grew stronger in spite of it.

"I called the foster mom directly because I had become very attached to baby boy -- so attached I wanted him to be mine.

"This is my son."

There were telephone calls and meetings with the social worker, paperwork and a weekend of anguish when state protocol required Ethan return to the original foster mom before he could relocate permanently.

"My heart broke! 'I have to give him back!' " Brittney said, her voice breaking.

"That was so hard, but I told myself I'd get him back on Monday and I'd never have to give him back again. Before that day finally came, it seemed like forever."

In his new foster home, Ethan thrived; his health improved so much so his doctors were amazed.

"We got him so chunky at one point he had no neck! He was just a butterball," Brittney said, chuckling at the memory of her smiley baby. "We checked in with his pediatrician, and the doctor was just blown away by how much better he was doing. He told us, 'He was meant for you guys.' "

A prognosis any parent would welcome.

On National Adoption Day in November 2016, Ethan officially became their son. With it came the decision to make "Ethan" his middle name (a nickname he had acquired in early foster care) and change his original birth name.

"Jaxx means 'God has been gracious; has shown favor,'" Brittney said with feeling. "I believe the Lord favored him, he guarded him and gifted him to us."

A blessing beyond measure.

College of choice: Learn Freedom and Faith on Campus

Hillsdale College is out of step with much of what goes on at American Colleges and universities.

Our students, do not demand “safe spaces” where their views can go unchallenged. Nor do they seek to deny the speech rights of fellow students, professors, or guest speakers with whom they disagree.

Hillsdale College is committed, by its Articles of Association, to provide “sound learning” essential to preserving “civil and religious liberty”—in other words, a liberal arts education that proceeds by free and open discussion.

Another way Hillsdale is out of step today stems from its commitment, also in its Articles of Association, “to teach by precept and example the essentials of the Christian faith.”

In keeping with this, the College is building a grand and beautiful chapel, called Christ Chapel, in the heart of campus. It’s named after the Philadelphia church where many of America’s Founding Fathers worshiped during the Continental Congress. It will provide a much-needed place of worship for all Hillsdale students, regardless of denomination.

Masaad Ayoob is a police chief and police trainer. He was of the belief Oswald couldn’t do it. In a class he taught on forensic re-enactment none of the right handed shooters could do it.

Oswald was right handed, but left eye dominant. Oswald shot left handed. Every lefty in Ayoob’s class made the shots in the timeframe Oswald did.

I too was a Marine like Oswald. Marines are better shots than 90 percent of the men you meet on the street.

I went to Deally plaza when I lived in Dallas. I literally laughed out loud at a conspiracy nut talking about impossible shots fired by Oswald. His LONGEST SHOT was 88 yards. I could have made those shots with my Ruger Blackhawk revolver in .41 Magnum.

Because business fundamentally is about money, it requires you to understand the bottom line -- which is impossible to do unless you can read and comprehend your company's financial statements.

"Financial statements are the box scores that tell everyone how your … business is doing financially," says Small Business Trends contributor Rob Starr.

"They usually contain two reports that tell the story of your finances: balance sheet and profit and loss statements."

Knowing what each of these statements show will help you make better decisions for your company.

The balance sheet lists your company's assets (i.e., what your company has) and liabilities (i.e., what your company owes).

"The balance sheet summarizes key financial information at any point in time. It provides an efficient way to determine health of the organization," Derek Carter, chief solutions officer for Ceterus, tells Starr, adding the bottom-line number on every balance sheet is the "current ratio" -- current assets divided by current liabilities.

"If the ratio is less than 1, that company could have issues paying their current liabilities."

Next: profit and loss statement, shows how profitable your business is over a specific period of time. "I suggest reviewing either several months at a time or year over year. Doing so will help you see trends and help drive future business decisions," Carter tells Starr, who says, "Spotting these trends will help you to make any adjustments quicker. If sales go down for several months in a row but payroll doesn't, it may be obvious you might need to do something with your number of employees."

     My name is Julie Quivey and I have been a summer flex week owner for 30 years. My sister (now deceased) also bought a week at the same time- my nephew (Steve Barr) now has her week.

     He and his wife are teachers and can only go on vacation in June and July. Since all those weeks are lottery weeks now I got week 23 (6-7-19 to 6-14-19) unit 303 and he got week 24 (6-14-19 to 6-21-19).

     We would like to vacation the same week if possible- Sharon Bohrer gave me your e-mail address and said you may be able to help us get the same week. We would like to trade week 23 for 24 or visa-versa.

Because the truth is too harsh for the public to know.

The atomic bombs dropped on Hiroshima and Naasaki, which people were made to believe that the US used to end the WWII with much less casualities for both the US and Japan, not only failed to do so, but in fact it was a big lie and they were intended for human experiments.

Truman knew ABombs would never be needed to end the War. He was looking down on Japanese as beasts, and this played a big role in his decision as shown in the timeline below:

(1) In September 1944, FDR met Churchill in Hyde Park, New York, and made the Hyde Park Agreement, in which both agreed that if the US succeeds in the ABomb development, it would be used on Japan, and not on Germany.

(2) Following the surrender of Nazi Germany on May 7, 1945, Churchill kept on urging Truman to hold the Potsdam meeting to end the WWII as soon as possible. However, Truman kept on postponing it until the first ABomb test day on July 16, 1945. The Potsdam meeting was scheduled to be held on the following day, July 17.

(3) On May 8, 1945, US summoned Japan to accept “unconditional surrender.” (The idea of unconditional surrender was FDR’s idea, and was first mentioned at Casablanca Conference on January 24, 1943.)

(4) However, the “unconditional surrender” is a term used for an army but not for a country. It has no definition in International Law, and under the Law of War, “unconditional surrender” in the sense used before the modern period could never be established legally in the 20th century. Thus the term bewildered not only Japan but everyone else including US law philosophers, US generals like Eisenhower, or even Churchill. (After the War, a world’s leading philosopher of law and International Law, Hans Kelsen, who taught at University of Harvard and California, Berkeley said with a laugh that there is NO WAY Japan as a COUNTRY had accepted “unconditional surrender.”)

(5) Joseph Grew, the former ambassador to Japan suggested from his experiences to Truman on May 28, 1945 that if the US agrees to keep the Emperor, Japan would surrender immediately.

(6) Pursuant to the Quebec Agreement (August 19, 1943), which imposed restrictions on US’s use of atomic bombs without prior consent by Britain, Truman requested Churchill at the beginning of June 1945 to sign in consent to use of ABombs on Japan. Churchill signed this agreement “Operational Use of Tube Alloys” on July 1. Note that neither FDR nor Truman had ever asked Britain for the same consent for Germany.

(7) Stimson agreed to Grew's idea and proposed it to the President on June 16, 1945. MacArthur also wrote that the Japanese would fight till the last person if the US would not promise to preserve the Emperor. Later, only Byrnes, who newly came to the office on July 3, 1945 disagreed and opposed.

(8) The Imperial Council of Military Leaders (最高戦争指導会議) in Japan passed a resolution to negotiate terms of surrender through the Soviets on June 22, 1945, without any knowledge of the US ABombs. The US found Japan started this negotiation in the same month of June 1945, and Omar Bradley, first Chairman of the Joint Chiefs of Staff in the US Army, reported to Truman after the Battle of Okinawa that Japan was in effect defeated and that it was trying to negotiate the terms of surrender. MacArthur also said to the General Staff Office that the War is over.

(9) Six out of all seven Five Star Generals and Admirals were against the use of ABombs with a view that Japan would surrender without them.

(10) Preservation of the Emperor was included in the US official proposal for the condition of Japan's surrender.

(11) However, on the way to Potsdam on Augusta, Byrnes succeeded in persuading Truman to remove the clause on the Emperor. Grew, Stimson and others were not on the ship.

(12) On July 16, 1945, in Potsdam, Truman received a message “Babies satisfactorily born," meaning that the first ABomb test “Trinity” as a part of the Manhattan Project was successfully carried out by the Los Alamos Laboratory and the US Army in a desert of New Mexico.

(13) Stimson arrived at Potsdam after the ABomb test, and asked Truman to re-include the clause of preserving the Emperor. But Truman very strongly refused by saying you can go home if you do not like it.

(14) During the first meeting in Potsdam on July 17, Truman asked Stalin, when the Soviets would invade Japan. Stalin replied August 15. (Japan had a non-aggression pact with the Soviets. But in the Yalta Conference held from February 4 to 11, 1945, FDR secretly agreed with Stalin to give the Soviets some parts of Japan in return for breaking the pact and invading Japan.) Truman wrote on this day's dairy that "He'll be in the Jap War on August 15th. Fini Japs when that comes about.” This means that if Truman uses ABombs BEFORE August 15, the purpose for their use must be something OTHER THAN ending the War.

(15) On July 25, 1945, Truman told Stimson to use the atomic bombs on Japan, and wrote on this day's diary that he is SURE that the Japs will NOT accept the Potsdam Declaration.

(16) On the following day, July 26, the Potsdam declaration was issued without a clause to preserve the Emperor, and was not signed by the Soviets confusing the Japanese. It was Truman that refused signing by Stalin. Even though the Soviets were not directly involved in the war against Japan at that time, it had already informed Japan in April 1945 that it would not extend the Non-Aggression Pact. Thus from the Japanese perspective, the Soviets were in a position that could attack Japan as part of the Allied Forces at anytime.

(17) On the same day, July 26, Truman gave commands to drop the ABombs on the earliest “clear" day after August 3, exactly one week after the Potsdam Declaration. The commands included detailed instructions to accompany with observation aircraft to record the effects of the ABombs. Note that BOTH commands for the two atomic bombs, the first Uranium one dropped in Hiroshima and the second Plutonium one dropped in Nagasaki, were given on the SAME day. Neither MacArthur nor Nimitz knew about the commands.

(18) Just before the planned Soviet's invasion date, the US dropped the ABombs on August 6 and 9, 1945. The B-29s were accompanied by an observation aircraft and another to film and photograph the bombings. The observation aircraft dropped several devices in various parts of the cities to register changes in temperature, atmospheric pressure, etc., during the explosions. Three of the devices were later collected and are displayed in the Hiroshima Peace Memorial Museum today. Los Alamos National Laboratory registered in its official record about the dropping of ABombs in Hiroshima and Nagasaki that the two "experiments” were successful.

(19) Upon hearing the news, the Soviet commenced the invasion of Manchuria on August 9, sooner than the previously planned date of August 15.

(20) On the following day, August 10, the Emperor issued an Imperial decree to accept the Potsdam Declaration. The reason for surrender, according to the Emperor as recorded in the Imperial Record (昭和天皇実録) declassified in 2015, was the Soviet’s invasion because Japan no longer had an ability to hold a two-front war. (Already 66 civilian cities were completely destroyed by the US’s indiscriminate bombing that the destruction of two more cities, Hiroshima and Nagasaki, could not trigger capitulation.) Subsequently, Japan accepted the Potsdam Declaration on August 15.

(21) Truman said in a TV announcement that the US dropped ABombs that they "invested” two billion dollars in.

(22) As early as September 1945, "The Armed Forces Joint Commission for Investigating Effects of the Atomic Bomb in Japan,” lead by Col. Ashley W. Oughterson who arrived in Japan on September 1, 1945, was formed and commenced large scale investigations. Some 1,300 Japanese doctors and scientists were pulled into the investigation examining more than 20,000 adult patients and 17,000 children. A wide range of experiments on patients were conducted disguised as treatments, examining reactions by victims to injections of various chemicals such as adrenaline. The policy, according to the doctors involved, was “What can be tested, should be tested." The results of these research and experiments were summarized in a 181 volume report consisting of more than 10,000 pages. But the results were never made public, and the reports were directly sent to the US Army while their existence was kept secret. The reports are now kept at the National Archives and Records Administration, NARA.

Also, intestines of 200 bodies were secretly sent to the Armed Forces Institute of Pathology in Washington, D.C., for further study without notifying their families. These intestines are now kept in formalin in universities in Hiroshima and Okayama.

Note that this was all done while Japan was still under the sway of GHQ before it regained its sovereignty.

(23) Based on the investigations, research and experiments, Col. Ashley W. Oughterson published in 1953 a six thick volume report "Medical effects of the atomic bomb in Japan,” of which one whole book is dedicated to studies on the effects on children. Then, from this, a graph of mortality and total casualty rates by atomic bombs vs distance from the hypocenter was created.

This became the basis for the US nuclear strategy as it gave the crucial figures to calculate the number of atomic bombs required to attack each enemy city. Some numbers of Hiroshima-type atomic bombs required to annihilate cities as calculated by the US Air Force from the graph are as follows: Moscow 6, Stalingrad 5, Vladivostok 3, Kirov 2, Tallin 4, Chelyabinak 3, etc.

As such, through these experiments, the US now became the only country in the world with Big Data for the effects of atomic bombs on target cities as well as on human bodies.

(24) On June 30, 1946, a confidential report, "United States Strategic Bombing Survey: The Effects of the Atomic Bombs on Hiroshima and Nagasaki,” prepared by the United States Strategic Bombing Survey (USSBS) was reported to Truman concluding that "Based on a detailed investigation of all the facts, and supported by the testimony of the surviving Japanese leaders involved, it is the Survey's opinion that certainly prior to 31 December 1945, and in all probability prior to 1 November 1945, Japan would have surrendered even if the atomic bombs had not been dropped, even if Russia had not entered the war, and even if no invasion had been planned or contemplated.”

(25) The Emperor Hirohito was not prosecuted in the Tokyo Tribunal, and he stayed as the Emperor. The position of the emperor was also kept under the new constitution which was illegally (by International Law) forced by the US. So the whole hustle about the preservation of the Emperor did not mean anything at all in the end.

(26) In his memoirs, Truman wrote "Japanese are beast. So are treated as."

(27) An acclaimed book "Just and Unjust Wars," written by a prominent US political philosopher at Harvard, Michael Waltzer, condemns the use of atomic bombs as crimes. Waltzer also accuses the US Government of not even trying to negotiate with the Japanese to surrender before the dropping of the bombs. He says it was a double crime in the sense that the US did not try to avoid, and that the bombs were dropped on civilian cities. This book is used as a text book at West Point today.
