Real estate Q&A: How can I help my children avoid probate after I'm gone?

Q: I live in a condo in a 55+ community and want to help my children avoid probate when I eventually pass away. What should I do? -- Sheryle

A: This is a question asked of me many years ago by my most loyal reader, my mother. I answered her question in person at the time and will now share that answer with you because my mother passed away this week, and her foresight with this question, and the action we took, will spare us the expense and hassle of having to probate her home.

Kindly remember that everyone's situation is unique, and a newspaper column is not a substitute for the advice of an estate planning attorney.

There are three good choices depending on your situation. The first choice is a Life Estate Deed, where property owners retain ownership of the home for their lifetimes, and when they die, the home passes to their initial choice of recipients without any further action being required. Simply, once the "life-tenant" passes away, the chosen person (or people), known as the "remainderman," automatically becomes the owner. The downside to this choice is that the chosen remaindermen are "vested," meaning their interest in the property is locked in. The property owner cannot later change his or her mind, sell or even mortgage the property without the remainderman's consent.

To fix this problem, an Enhanced Life Estate Deed was developed. This type of deed became known as a "Lady Bird Deed" following an article years ago illustrating its uses by a prominent Florida attorney. The name stuck, as did the document because of its usefulness. This type of ownership is very similar to a standard life estate, but the remainderman's interest in the property is not vested, meaning the homeowner can freely change his or her mind about who takes the property afterward, and can sell or mortgage the property without anyone's consent. This flexibility can also be a downside, since some seniors are susceptible to influence and may be coerced into making changes that are not in their best interest.

The final choice is to set up a living trust. This choice provides the most flexibility and is best for people with more assets to plan for. While trusts are almost all upside, the negative is they are significantly more expensive and complicated to set up than either type of life estate deed.

The federal government is broken. Career politicians in Washington will never limit their own power.

Our Founding Fathers entrusted us -- the American people -- with authority to call a Convention of States to propose amendments to limit federal power.

The U.S. Constitution dictates  everything not specifically designated to the federal government should be entrusted to the states.

That's not what’s happening today. Most states only control 40% of issues pertaining to their own money -- unelected bureaucrats decide the rest.

Sixty percent of the time… someone sitting in an office on the other side of the country… who was never even elected… makes decisions that directly impact your life.

Masaad Ayoob is a police chief and police trainer. He was of the belief Oswald couldn’t do it. In a class he taught on forensic re-enactment none of the right handed shooters could do it.

Oswald was right handed, but left eye dominant. Oswald shot left handed. Every lefty in Ayoob’s class made the shots in the timeframe Oswald did.

I too was a Marine like Oswald. Marines are better shots than 90 percent of the men you meet on the street.

I went to Deally plaza when I lived in Dallas. I literally laughed out loud at a conspiracy nut talking about impossible shots fired by Oswald. His LONGEST SHOT was 88 yards. I could have made those shots with my Ruger Blackhawk revolver in .41 Magnum.

Flat fee classified advertising - let me tell you how and why



The top line with the arrows show you have signed in correctly with your name on the left and WHMBTV on the right.

Under Main Menu you only have two options, find the content and sign off. When you click the "Content" button, the list of accounts you can access will be listed from newest at the top and oldest at the bottom. It will display 50 items per page.

Under the "Content" button you also have two options - add a new listing or export data from any or all of the listings.

All of the fields in the box that contains your name (in red) under "Owner" are fields in each listing that let you search for specifics. That can be useful if someone says they searched for their e-mail and couldn't find it, you can cut and paste it into that field and if it doesn't work, it isn't there. But if you look at what you use to contact them and search and it appears, it tells you the one listed is incorrect.

Most often you will know the ad id# and use it to find the account.

If the e-mail address is "form" it tells you that the web site requires you to fill out their form to send a message. We need a specific e-mail to a specific person for dealing with their account.

Under the space it says "Send batch Email" you will find a pull down menu with prewritten notices. If you do a search and find just one listing and click the "Email" button below it, the system sends that e-mail to just that one account. None will go to the listing with the "form" because it is not a correct e-mail format.

Seeing your picture in my email weekly makes it feel like we’ve met but I don’t think we have had the occasion.  My parents bought Eagle’s Nest back in the 70s and my family had been coming to Marco Island through their ownership. I don’t recall when we took over but we now own the condo for week 2 since, maybe, the 90s.  

I don’t know if you were looking for responses to this email but I have to say that I was quite happy when I heard about the Friendship List and have used it. I found the process of dealing with the owners directly easy and manageable. I think owners are happy to know that another owner is benefitting from their inability to use the week(s).  It also provides the owner with a monetary benefit. I have not ever tried to rent additional time from management but would imagine there is an additional cost as they need to make money to pay their staff; direct rental through the owner is like buying a house without the realtor expense.

That’s my take on this for what it’s worth.  I appreciate the amount of work it is for you to maintain the listings especially since you have had some technical issues recently. As an owner of one week I will defer to others who have several weeks of ownership at this great place.  

Maybe we will meet sometime.  If not, thank you for your efforts with the List.

We as owners appreciate all that you have done to provide a service for us as owners. I feel your service benefits the owners first before the renter who comes in off the street wishing to spend the night at Eagle's Nest.
Last year we were able to rent two weeks from your list in units that we knew were ADA since I am a paraplegic in a power chair and can no longer use our tower unit.  The owner in turn got the full amount of the rental instead of 2/3 of it and it benefited the owner as well as the renter!  We were not able to find a renter for our week so we deposited with II for a trade which we are using this May.
This is a wonderful service you have provided for the owners and I hope you will not give it up!

You are providing owners a very valuable service.  Through this service owners can work directly with other owners on pricing their units for rent.   Eagles Nest does not offer this service.  If putting up our unit through Eagles Nest there  is a set price and we as owners have no say to who rents our unit.  Many times we just want to pay our annual fees through renting the unit when we are not able to use the unit.  Through Eagles Nest we may end up not getting. Rental at all because of their set pricing per day or per week.  Your service is  available to all.  Unfortunately, Eagles Nest does not allow all owners to learn about the service.
Please keep doing what you are doing in support of the owners.

Don, I am very much a fan of this Friendship List and I encourage you to keep it going. I disagree that this is detrimental to eagles nest, though hearing Mona's position would be interesting.There are certainly other web sites doing the same thing, albeit for a fee. Your list brings important flexibility for owners to easily match weeks with their personal schedules and that then allows additional family members to rent the same weeks. Limiting those options, or leaving me with an unused week, does not make for happy owners. Also I think staff or sales people unnecessarily make what they have available difficult to determine as they won't post exact dates and prices, despite how convenient technology makes things. I strongly encourage you to stay the course. Competition and "free press" are good for all of us. Thanks for listening and for the service you provide.

I wouldn’t recommend it.

Honestly, your sentences will just sound wrong. Everyone will notice you’re doing something different. Your writing won’t flow smoothly. You’ll use weird words.

It’s not worth the effort involved in spending time online looking up tons of synonyms which don’t feel right, just to produce weird, stilted prose.

You’d be better off giving up, to be honest.

In 2006, George Wright joined Blendtec as the small company’s Marketing Director.

Now, George Wright was accustomed to a much larger marketing budget than Blendtec could offer. He would even joke all of Blendtec’s revenues were less than his marketing budget at George’s previous company.

So how did George increase Blendtec’s revenue by 700% in the next two years?

Well, Tom Dickson, Blendtech's founder, had a unique way to test his products, as George would soon learn. Tom would use wooden boards to study the durability of the blenders, to see how much strain he could put on his inventions before they broke.

This gave George an idea. He went to the store and got a few common, inexpensive items: marbles, golf balls, a rake, and a white lab coat for Tom.

The blender turned each item to dust while George captured the carnage on camera. He then uploaded the video to YouTube, and “Will it Blend?” was born.

The series was wildly successful.

That first week, his videos reached 6 million views. People were amazed by the  Blendtec blender's strength, and sales shot up.

You don’t necessarily need a huge budget to run a successful marketing campaign. You just need a great idea and the power of word-of-mouth.

Imagine you had won the Following *PRIZE* in a contest:

Each morning your bank would deposit $86,400 in your account.
However, this prize has Rules:
1. Everything you didn't spend each day would be taken away.
2. You may not transfer anything into some other account.
3. You may only spend it.
4. Each morning when you wake up, the bank account with another $86,400 had been deposited.
